Where a dispute arises between parties often experts are required to provide an independent opinion. Dabinett have acted as expert witnesses many times, providing independent advice to aid and inform parties and their legal counsel.
Dabinett’s involvement with a claim may be from early on, prior to matters progressing towards court. In these circumstances often reports are provided to set out basis of claims from a technical perspective.
When matters do proceed to court then expert witness reports are completed in accordance with the Civil Procedure Rules (CPR). Section 35 of the CPR sets out the role of the expert witness. In addition the Royal Institution of Chartered Surveyors have mandatory practice note on the role of the surveyor in acting as an expert witness.
The constant involvement of the Dabinett’s surveyors in ongoing projects in a wide range of specialisms provides the grounding to offer genuinely expert knowledge and advice.
Disputes have varied from residential contractural disputes between contractors and householders, commercial disputes between landlords/tenants and contractors/clients.
